DATA ACCESS AGREEMENT These terms and conditions govern access to the managed access datasets (details of which are set out in Appendix I) to which the Researcher has requested access. The Researcher agrees to be bound by these terms and conditions. Definitions Researcher/Recipient: The individuals that have been granted access to the Data, as named in Appendix II. Data: The managed access datasets to which the Researcher has requested access. Data Producers: the collaborators listed in Appendix I responsible for the development, organisation, and oversight of these Data. Publications: Includes, without limitation, articles published in print journals, electronic journals, reviews, books, posters and other written and verbal presentations of research. User Institution(s): The Institution that has requested access to the Data. Data deposited may be accessed and analysed provided that the Researcher confirms that they are, and will at all time in the future be, compliant with the conditions listed below. If at any time the Researcher is no longer compliant with the conditions listed below, the Researcher undertakes to destroy all Data in the Researcher’s possession or under the Researcher’s control. 1. Data shall only be used for the purpose of undertaking bona fide research relating to human evolution, the histories of one or more populations and genetic history which it is intended to publish in a reputable peer reviewed journal. 2. Data shall only be viewed and analysed by the Researcher and Researcher’s bona fide collaborators engaged in research undertaken in accordance with (1) above. 3. No attempt shall be made to connect Data with a Personal Identifier not included in the Data. 4. Data shall not be accessed or analysed for commercial purposes. 5. Data shall not be used to create or protect patent or other intellectual property right. 6. The Researcher agrees that the Data Producers, and all other parties involved in the creation, funding or protection of these Data: a) make no warranty or representation, express or implied as to the accuracy, quality or comprehensiveness of these Data; b) exclude to the fullest extent permitted by law all liability for actions, claims, proceedings, demands, losses (including but not limited to loss of profit), costs, awards damages and payments made by the Recipient that may arise (whether directly or indirectly) in any way whatsoever from the Recipient’s use of these Data or from the unavailability of, or break in access to, these Data for whatever reason and; c) bear no responsibility for the further analysis or interpretation of these Data. 7. The Researcher agrees to follow the Publication Policy in Appendix II, i.e. to properly cite the paper where these data were first reported. 8. The Researcher will notify Garrett Hellenthal as soon as it becomes aware of a breach of the terms or conditions of this agreement. 9. The Data Producers or any one thereof may terminate or if they so decide amend this agreement by written notice to the Researcher if in the reasonable opinion of the Data Producers the Researcher is not acting or intends not to act in compliance with the terms of this Agreement or for any reason it is not appropriate to analyse part or all of the data. If this agreement terminates for any reason, the Researcher will be required to destroy any Data held, including copies and backup copies. This clause does not prevent the Researcher from retaining these data for archival purpose in conformity with audit or legal requirements. 10. The Researcher accepts that it may be necessary for the Data Producers or any one thereof to alter the terms of this agreement from time to time. In the event that changes are required, the Data Producers or their appointed agent will contact the Researcher to inform it of the changes and the Researcher may elect to accept the changes or terminate the agreement. 11. If requested, the Researcher will allow data security and management documentation to be inspected to verify that it is complying with the terms of this agreement. APPENDIX I – DATASET DETAILS Dataset reference (EGA Study ID and Dataset Details): EGAS00001006944. Genotype data for 1510 individuals, genotyped on the Affymetrix Axiom Genome-Wide Human Origins 1 Array. Name of project that created the dataset: Dense sampling of ethnic groups within African countries reveals fine-scale genetic structure and extensive historical admixture Names of Data Producers: Neil Bradman, Mark Thomas, Garrett Hellenthal Specific limitations on areas of research: Data shall only be used for the purpose of undertaking bona fide research relating to human evolution, the histories of one or more populations and genetic history which it is intended to publish in a reputable peer reviewed journal and as further described herein in Clauses 1 to 5 inclusive. Minimum protection measures required: File access: The data must be securely stored, ensuring it is not accessible to people outside of the persons described in Clause 2 above.
