Data Access Policy
ENDOGENE.BIO DATA ACCESS COMMITTEE DATA ACCESS AGREEMENT - ENDOGENE.BIO DATA ACCESS AGREEMENT FOR ACADEMIC RESEARCH This Data Access Agreement ("Agreement") between EndoGene.Bio ("EndoGene") and the User and User Organization (as defined below) governs the terms on which access will be granted to the genomic and phenotypic data obtained from EndoGene.Bio projects uploaded to the European Genome-phenome Archive (EGA). By signing this Agreement, User and User Organization agree to be bound by the terms and conditions of access set out in this Agreement. For clarity, the terms of access apply to both the User and the User Organization. "You" and "Your" refer to both User and User Organization. Definitions Data means all human genetic, molecular, or phenotypic data obtained from EndoGene.Bio projects and uploaded to EGA Data Subject means a person who has provided informed consent for the use of their data. User means a researcher whose User Organization has completed this Data Access Agreement and has received acknowledgment of its acceptance. User Organization means the academic or public research institution where the User is affiliated. EndoGene Data Access Committee means the committee responsible for reviewing and approving requests for access to EndoGene.Bio data. DUO Codes mean the Data Use Ontology terms assigned to the dataset, indicating usage restrictions as follows: DUO:0000015 (NMDS) - No general methods research. DUO:0000018 (NPUNCU) - Not for profit, non-commercial use only. DUO:0000021 (IRB) - Ethics approval required. DUO:0000019 – Publication required. Terms and Conditions 1.- Permitted Use You agree to use the Data solely for the advancement of academic, non-commercial research. You agree that the Data may not be used to train AI or machine learning models. The Data must be used in accordance with the DUO codes assigned: DUO:0000015, DUO:0000018, DUO:0000021, DUO:0000019. 2.- Eligibility and Ethical Approval Access is limited to researchers affiliated with recognized academic or public research institutions. Users must hold valid ethical approval from their local Institutional Review Board (IRB/ERB) as indicated by DUO:0000021. 3.- Confidentiality and Data Protection You agree to preserve, at all times, the confidentiality of Data relating to Data Subjects. You shall not attempt to re-identify participants or link data with external sources to do so. All processing of Data must comply with GDPR and relevant national data protection laws. Data must be stored securely and destroyed or anonymized upon project completion. 4.- Restrictions Data shall not be shared with third parties outside your organization without a separate access request and approval by the DAC. Data shall not be used for commercial purposes, as indicated by DUO:0000018. 5.- Publications and Acknowledgement You are free to publish results derived from the Data for the approved purpose. Publications must acknowledge the source: “Data were obtained from EndoGene.Bio projects, hosted at the European Genome-phenome Archive (EGA, accession number [EGASxxxxxxx]). Access granted for academic, non-commercial research purposes”. All Intellectual Property (IP), including but not limited to any derivative works, discoveries, analysis, methods, or any other outputs generated directly or indirectly from the use of the Data, shall be considered to originate from and be owned by EndoGene.Bio. 6.- Compliance You agree to comply with all applicable laws, including data privacy laws. EndoGene reserves the right to request and inspect documentation regarding data security measures. Any breach of this Agreement will result in immediate revocation of access and destruction of Data. 7.- Duration and Termination This Agreement is effective from the date of last signature and shall remain valid for three (3) years unless terminated earlier. Sections relating to confidentiality, permitted use, compliance, and acknowledgements survive termination.
